1. Agreement to These Terms

These Terms of Service (“Terms”) govern your access to and use of Donum AI, including our website, app pages, AI Coach, workout logging tools, progress features, subscription features, and related services (collectively, the “Service”).

By accessing or using the Service, creating an account, starting a free trial, or purchasing a subscription, you agree to these Terms.

If you do not agree to these Terms, do not use the Service.

2. Description of the Service

Donum AI is an AI-powered fitness coaching and workout tracking platform.

The Service may help users:

create and adjust workout plans;
log workouts and training sessions;
track strength and performance progress over time;
review exercise history and personal records;
receive AI-generated fitness guidance;
adapt general training suggestions around user-provided limitations;
build long-term fitness habits through consistency tracking.

Donum AI is a fitness and training tool only. It is not a medical service and does not provide medical advice, diagnosis, treatment, rehabilitation, physical therapy, emergency support, or professional healthcare services.

3. Eligibility

To use the Service, you must:

be at least 18 years old;
have the legal capacity to enter into a binding agreement;
not be prohibited from using the Service under applicable law;
use the Service only for lawful purposes.

By using Donum AI, you represent and warrant that you meet these requirements.

If you are under 18, you may not create an account or use the Service.

4. User Accounts

You may need to create an account to access certain features of the Service.

You agree to:

provide accurate, current, and complete account information;
keep your login credentials secure;
not share your account with another person;
notify us promptly if you suspect unauthorized access to your account;
be responsible for activity that occurs under your account.

Authentication may be provided through third-party authentication services such as FrameAuth. Donum AI does not directly receive or store your account password.

We may suspend or terminate your account if we believe that you have violated these Terms, misused the Service, created risk for Donum AI or other users, or engaged in fraudulent, abusive, or unlawful activity.

5. Fitness Profile, Workout Data, and User Content

You may submit information to the Service, including:

fitness goals;
experience level;
training days per week;
available equipment;
preferred weight unit;
preferred weight increment;
workout logs;
exercises, sets, reps, weights, and notes;
training limitations or movements to avoid;
messages sent to the AI Coach.

You retain ownership of the content and data you submit to Donum AI.

By submitting content to the Service, you grant Donum AI a limited, non-exclusive, worldwide license to use, process, store, display, and transmit that content only as needed to:

provide the Service;
personalize your experience;
generate AI-assisted responses;
save and display workout history;
calculate progress and training metrics;
provide support;
maintain security and reliability;
comply with legal obligations.

You are responsible for the accuracy of the information you provide.

You should not submit medical records, diagnoses, prescriptions, lab results, detailed medical history, or other highly sensitive medical information.

6. AI Coach and AI-Generated Output

Donum AI uses automated systems and third-party AI workflow providers to generate fitness-related responses, summaries, and suggestions.

AI-generated output may be:

incomplete;
inaccurate;
outdated;
unsuitable for your individual circumstances;
based on incomplete or incorrect information you provided.

You are responsible for reviewing AI-generated recommendations before relying on them.

Donum AI does not guarantee that AI-generated responses will be correct, safe, complete, or appropriate for your specific body, health, goals, equipment, or training environment.

Donum AI does not use AI to provide:

medical diagnosis;
medical treatment;
rehabilitation plans;
physical therapy;
emergency advice;
legal, financial, or professional healthcare decisions.

7. Health and Fitness Disclaimer

Important: Please read this section carefully.

Donum AI provides general fitness information, workout tracking tools, and AI-generated training guidance for informational and motivational purposes only.

Donum AI is not a medical service.

Donum AI does not provide:

medical advice;
medical diagnosis;
medical treatment;
injury diagnosis;
physical therapy;
rehabilitation services;
emergency services;
professional healthcare services.

AI-generated training recommendations are not a substitute for advice from a doctor, physical therapist, certified personal trainer, or other qualified professional.

Before starting a new exercise program, changing your training, or following any recommendation from the Service, you should consult a qualified professional if you have:

an existing medical condition;
an injury;
pain;
dizziness;
heart, joint, back, or mobility concerns;
uncertainty about whether exercise is safe for you.

You agree that:

you are responsible for your own training decisions;
you are responsible for using proper form, equipment, judgment, and supervision;
you should stop exercising and seek appropriate help if you experience pain, dizziness, shortness of breath, injury symptoms, or unusual discomfort;
you assume the risks associated with exercise and physical activity.

To the maximum extent permitted by law, Donum AI is not responsible for injuries, health issues, damages, or losses resulting from your use of the Service or your implementation of any fitness recommendation.

8. Subscriptions, Free Trials, and Payments

Donum AI may offer paid subscription access to certain features.

Payments are processed by Stripe or another payment provider. By starting a trial or subscription, you agree to the payment terms presented at checkout.

8.1 Early Access Price

The planned Early Access subscription price is:

$19/month

This price may be promotional, limited, or subject to change in the future.

Current pricing will be displayed on the website or checkout page before you subscribe.

8.2 7-Day Free Trial

Donum AI may offer a 7-day free trial with a payment method required.

If you start a free trial:

you must provide a valid payment method;
you will not be charged during the trial period;
your paid subscription will automatically begin at the end of the trial unless you cancel before the trial ends;
after the trial, you authorize Stripe or the payment provider to charge your payment method on a recurring monthly basis.

You are responsible for canceling before the end of the trial if you do not want to become a paid subscriber.

8.3 Recurring Billing

Subscriptions renew automatically unless canceled.

By purchasing a subscription, you authorize Donum AI and its payment provider to charge your payment method for recurring subscription fees, applicable taxes, and other charges shown at checkout.

8.4 Cancellation

You may cancel your subscription at any time.

If you cancel:

cancellation will take effect at the end of the current billing period;
you will retain access to paid features until the end of the paid period;
you will not be charged for the next billing period after cancellation takes effect.

You may cancel through your account, Stripe Customer Portal, or other cancellation method provided by Donum AI.

8.5 Refunds

Payments are non-refundable except where required by law.

We do not provide refunds or credits for:

partial subscription periods;
unused time;
failure to use the Service;
forgetting to cancel before renewal;
dissatisfaction after the billing period has started.

We may review billing issues on a case-by-case basis, but we are not obligated to provide a refund unless required by law.

8.6 Price Changes

We may change subscription pricing in the future.

If a price change affects your current subscription, we will provide notice where required.

Price changes will apply according to the terms presented at the time of notice or renewal.

9. Acceptable Use

You agree to use the Service only for lawful, personal, and permitted purposes.

You agree not to:

violate applicable laws or regulations;
use the Service if you are under 18;
share your account credentials with others;
impersonate another person;
attempt to access another user’s account;
interfere with the operation or security of the Service;
attempt to bypass authentication, security controls, rate limits, or access restrictions;
reverse engineer, decompile, copy, or attempt to extract source code;
use bots, scrapers, crawlers, or automated tools without permission;
upload malicious code or harmful content;
abuse, overload, or disrupt the Service;
resell, sublicense, or commercially exploit the Service without written permission;
use the Service to harass, harm, threaten, or exploit others;
submit medical records or highly sensitive medical information;
rely on the Service for emergency, medical, or professional healthcare decisions;
use AI responses to create unsafe, illegal, harmful, or abusive content.

We may suspend or terminate access if we believe your use violates these Terms or creates risk for Donum AI, our systems, or other users.

10. Intellectual Property

10.1 Donum AI Content

The Service, including its design, interface, branding, logo, software, workflows, features, text, visual elements, and platform content, is owned by Donum AI or its licensors and is protected by intellectual property laws.

You may not copy, reproduce, modify, distribute, sell, or commercially exploit any part of the Service unless we give you written permission.

10.2 User Content

You retain ownership of the workout data, messages, notes, and other content you submit.

You grant Donum AI the limited license described in Section 5 solely for operating, personalizing, securing, and improving the Service.

10.3 Feedback

If you send us feedback, suggestions, ideas, or requests, you allow us to use them without restriction or compensation to you.

We are not required to implement any feedback.

11. Privacy

Your use of the Service is also governed by our Privacy Policy.

The Privacy Policy explains how we collect, use, store, disclose, and protect personal information.

12. Account Deletion

You may request deletion of your Donum AI account data through:

Settings → Delete account

You may also contact us at:

After a confirmed account deletion request:

active Donum app data may be deleted promptly or within 30 days;
FrameAuth account deletion may require manual processing and may be completed within 30 days;
certain payment, subscription, security, support, tax, accounting, fraud-prevention, or legal records may be retained where required or permitted by law.

Deleting your account may permanently remove your profile, settings, workout history, progress data, and related app records.

13. Service Availability and Changes

We may modify, suspend, discontinue, or limit any part of the Service at any time.

We do not guarantee that the Service will be:

uninterrupted;
error-free;
always available;
compatible with every device or browser;
free from data loss or technical issues;
available in every country.

We may update features, change AI behavior, adjust limits, remove functionality, or make improvements without prior notice.

14. Third-Party Services

Donum AI may rely on third-party services for:

authentication;
website hosting;
backend infrastructure;
database storage;
AI workflow orchestration;
payment processing;
email and domain services.

These third-party services may include providers such as FrameAuth, Framer, Cloudflare, Airtable, Voiceflow, Stripe, and United Domains or email providers.

Third-party services are governed by their own terms and privacy policies. Donum AI is not responsible for third-party services outside our control.

15. Disclaimer of Warranties

The Service is provided “as is” and “as available.”

To the maximum extent permitted by law, Donum AI disclaims all warranties, express or implied, including warranties of:

merchantability;
fitness for a particular purpose;
non-infringement;
accuracy;
reliability;
availability;
security;
suitability for your goals, health, or training needs.

We do not warrant that:

the Service will meet your expectations;
AI-generated responses will be accurate or safe;
workout recommendations will be appropriate for you;
the Service will be uninterrupted or error-free;
all defects will be corrected;
the Service will be free of harmful components.

16. Limitation of Liability

To the maximum extent permitted by applicable law, Donum AI and its operator shall not be liable for any:

indirect damages;
incidental damages;
special damages;
consequential damages;
punitive damages;
lost profits;
lost data;
loss of goodwill;
business interruption;
personal injury or health-related harm arising from use of the Service;
damages resulting from reliance on AI-generated output.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service shall not exceed the greater of:

the amount you paid to Donum AI in the three months before the event giving rise to the claim; or
$50.

Some jurisdictions do not allow certain limitations of liability. In those cases, the limitation applies to the maximum extent permitted by law.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Donum AI and its operator from claims, damages, losses, liabilities, costs, and expenses arising from:

your use of the Service;
your violation of these Terms;
your violation of applicable law;
your submitted content;
your misuse of AI-generated output;
your training decisions or exercise activity based on the Service.

18. Termination

You may stop using the Service at any time.

We may suspend or terminate your access to the Service if:

you violate these Terms;
you misuse the Service;
your use creates legal, security, or operational risk;
payment fails or your subscription ends;
we discontinue the Service.

After termination, your right to use the Service ends immediately.

Sections that by their nature should survive termination will remain in effect, including sections related to intellectual property, disclaimers, limitation of liability, indemnification, payment obligations, dispute resolution, and governing law.

19. Governing Law

These Terms are governed by the laws of Germany, without regard to conflict of law principles.

If you are a consumer, nothing in these Terms limits any mandatory consumer protection rights that cannot be waived under applicable law.

20. Dispute Resolution

If a dispute arises, we encourage you to contact us first so we can try to resolve it informally.
